Get Ready for Electric Scooters: Who is Responsible?

Fall is finally here in Oklahoma. Between the golden leaves and cool crisp air, you will begin to see electric scooters flooding the city streets. These rental scooters can be found along the curb in hundreds of U.S. cities including Oklahoma City, Tulsa, Norman, and Stillwater. Before you download the app and hop on, there are a few things you should know to protect yourself.

According to Consumer Reporters, eight people in the U.S. have died while using a rent-by-the-minute dockless electric scooter since the fall of 2017. One of those deaths was a 5-year-old boy who was riding with his mother in Tulsa in April.

Along with numerous injuries, these deaths highlight the potential dangers of the scooters. Understanding the insurance implications related to electric scooters will help you make responsible decisions.

Your health insurance could help defray the cost of medical bills in case of an accident. But what if you are riding a scooter and you hit a pedestrian, damage someone’s property or cause a car accident? You might think your auto insurance would kick in; however, most car insurance doesn’t generally cover vehicles with less than four wheels. Homeowner’s or renter’s insurance may cover an accident that occurs on a traditional bicycle, but it does not cover motorized bike or scooter trips. 

The two largest scooter companies in the United States generally place the responsibility for accidents on riders by listing in their rental agreements that riders relieve the companies of liability. You must agree to those terms before you can ride. And despite the scooter companies’ liability insurance, responsibility for damages is likely to fall on your shoulders because of the terms and conditions agreed upon when you downloaded the app.

What can you do to protect yourself? Call your insurance agent. You may be able to add an umbrella policy to your homeowner’s or renter’s insurance policy. An umbrella policy can cover more scenarios and include higher limits for coverage than a typical policy.

There are a few other ways to protect yourself on an e-scooter.

  • Wear a helmet: While it is not required by law in Oklahoma to wear a helmet while riding a scooter or a bicycle, it is highly recommended. 
  • Operate the scooter in right-hand lanes and bike lanes where possible: Your agreement with your scooter rental company will tell you to use streets and bike lanes. Riding motorized scooters on sidewalks is illegal in most cities, and you can be cited for doing so. Know where you can ride before you hop on.
  • Keep your eyes on the road: You may be tempted to share photos or videos of your new adventure on social media while operating. Always pay attention to the road. 
  • Inspect the scooter before you ride: Check to make sure the brakes are working properly before taking off.

I’m encouraging everyone who plans to ride an electric scooter, to get ready. Know your coverage. Anticipate what could happen, and know what your insurance will and won’t cover. And most importantly, be careful.

Bill to create statewide sexual assault kit tracking system signed

OKLAHOMA CITY – The Governor signed legislation Monday to help Oklahoma law enforcement investigate sexual assault crimes by creating a statewide tracking system for sexual assault evidence collection kits.  Sen. Kay Floyd (D-Oklahoma City) is the author of Senate Bill 967, and was a member of the 2017 Oklahoma Task Force on Sexual Assault Forensic Evidence (SAFE).

            “The task force agreed a major challenge solving sexual assault cases was that law enforcement agencies around the state were using tracking systems that weren’t compatible with other systems.  There needed to be a consistent process to investigate and solve these sexual assault cases,” said Floyd.  “By having one tracking system, law enforcement will be able to cross-reference thousands of crimes and DNA samples to solve more cases and prevent future sexual assaults.”

            SB 967 directs the Oklahoma State Bureau of Investigation’s (OSBI) Criminalistics Services Division to create a statewide electronic tracking system for rape kits including those found in the 2017 statewide audit. It will track a kit’s location and whether it has been processed. By January 1, 2020, all law enforcement agencies, forensic labs, medical providers and others in the state who have custody of rape kits will be required to participate in the tracking system. The system will also be accessible anonymously by victims.

“Oklahoma has one of the highest rates of rape and attempted rape in the nation. This new tracking system will better ensure that all kits are tested and DNA collected, and will provide more accessibility for allowing victims to track their kits,” said Floyd.  “Most rapists will commit multiple crimes, typically until they’re caught. Having this DNA evidence in one statewide system will hopefully help solve more cases and provide some peace to the victims knowing their assailant is no longer walking free.”

SB 967 will go into effect July 1, 2019.

Sen. Sharp continues fight to stop distracted driving

OKLAHOMA CITY – Continuing his efforts to make Oklahoma’s roads safer, Sen. Ron Sharp has filed legislation to once again try to outlaw the use of hand-held electronic devices while driving unless it is with hands-free technology.  Senate Bill 1088 would expand the Trooper Nicholas Dees and Trooper Keith Burch Act of 2015 to try to decrease the number of distracted drivers on Oklahoma roads.  

            “Currently, texting while driving or using any device to surf the internet or post to social media is illegal.  However, drivers can still hold their phone to talk or use other electronic devices while driving,” said Sharp, R-Shawnee. “Last year, there were nearly 8,800 crashes and 35 deaths, including three in my Senate district, caused by distracted driving throughout the state. We need to strengthen the law.  It’s just too dangerous and the costs are too high. We must do all we can to make Oklahoma’s roads safer.”
            SB 1088 would strengthen the law to prohibit not just texting while driving but using any kind of hand-held device while behind the wheel unless it is with a hands-free accessory.  The bill would not apply to those using their phones in emergencies.

            According to the Oklahoma Highway Safety Office’s (OHSO) 2018 Oklahoma Crash Facts, approximately 21,000 Oklahomans were involved in nearly 8,800 crashes caused by some form of distracted driving.  The largest age group of distracted drivers were those 20-24 followed by the 25-29 age group. More than 8,100 of the driver conditions reported were marked as “apparently normal”, “unknown” or “other” meaning the driver was not intoxicated, drugged, medicated, tired or sick.  

Nearly 1,800 drivers admitted that an electronic communication or some other kind of device distracted them. Again, the largest age group distracted by electronic devices was those ages 15-29. Around 4,200 drivers said something else distracted them inside their car while the other 2,900 said they were distracted by something outside their car.

            “The collision reports show that more than 90 percent of distracted driving accidents last year weren’t caused by alcohol, drugs, illness or being tired. Most of these individuals were distracted by electronic devices or something else in their vehicle.  While we can’t prevent all the distractions that happen inside vehicles, we can stop the use of electronic devices without hands-free capabilities,” Sharp said.  “We’ve got to take this issue seriously and help keep Oklahoma drivers’ eyes on the road where they belong.”

OHSO breaks down distracted in four categories including distraction by an electronic communication device, other electronic device and something other than an electronic device inside the car or outside the car. The agency combines all four categories in order to examine overall distracted driving crashes. OHSO also noted that distraction while driving is largely self-reported, so the actual numbers are more than likely much higher.

Sharp has been a strong advocate for strengthening Oklahoma’s texting and driving/distracted driving laws having filed numerous legislation since 2012. He filed similar language to SB 1088 with SB 44 in 2017 but the bill was not given a hearing in Senate committee. He was also the original Senate principal author of the Trooper Nicholas Dees and Trooper Keith Burch Act of 2015 (HB 1965) before authorship changed to the full Senate Public Safety Committee. 

Gov State Announces Cutting-Edge Rapid Point-of-Care COVID-19 Tests Being Distributed to Oklahoma

OKLAHOMA CITY (Oct. 1, 2020) – Governor Kevin Stitt today announced Oklahoma has received an initial allocation of roughly 77,000 Abbott Laboratories BinaxNOW rapid point-of-care COVID-19 tests. 

The Oklahoma State Department of Health will prioritize the distribution of these tests and equipment to K-12 schools, high-risk health care workers and other vulnerable populations. More specific details will be available in the coming days. 

“Distributing rapid point-of-care tests across our state will be incredibly valuable to keep our schools open for in-person instruction while protecting Oklahomans from this virus,” said Gov. Stitt. “These tests will also help us keep our frontline healthcare workers and their families safe as they continue their important mission of caring for the sick and our most vulnerable.” 

The BinaxNOW COVID-19 test uses nasal swabs that are simple to administer, inexpensive and can be easily employed by medical personnel or trained operators in certain non-clinical environments operating through a CLIA certificate. OSDH will provide training to locations receiving testing equipment, and those sites will be permitted to conduct tests through OSDH’s CLIA certificate. 

Results are provided on-site in 15 minutes or less. 

“Oklahoma has been on the cutting edge of testing our population for COVID-19 and we are excited to add this test to our arsenal as we combat this disease and keep Oklahomans safe,” said Dr. Lance Frye, Interim Commissioner of Health. “We want the public to know we have plenty of testing capacity, so if you have any fear of exposure, get tested.” 

This allocation is part of 100 million rapid tests scheduled to be distributed by the end of the year to the nation’s governors free of charge from the federal government. 

States will continue to receive allocations from the federal government as more BinaxNOW tests are manufactured. According to Abbott Diagnostics, it plans to make up to 48 million tests available monthly in the U.S. in the coming weeks. 

Free COVID-19 testing continues to be available at more than 80 sites across the Oklahoma. 

While many other states continue to only test patients with symptoms, Oklahoma has made a concerted effort to expand its testing capability to ensure any Oklahoman who wants a test can get one, and in most cases, can now receive a result in as few as 48 hours from test administration.

Get Ready for Open Enrollment 2020 What you need to know before applying

Open enrollment for 2020 individual health insurance plans under the Affordable Care Act (ACA) starts November 1 and ends December 15. If you want your coverage to start on January 1, you must sign up by December 15. With a new insurer available for the Oklahoma City area, there are some important things you need to know about the 2020 open enrollment before you apply. I urge all Oklahomans who plan to enroll for 2020, to not automatically renew. Look closely for changes. 

In 2017 and 2018, Blue Cross Blue Shield of Oklahoma (BCBSOK) was the only insurance carrier offering plans in the Oklahoma exchange. However, Medica joined the Oklahoma exchange for 2019 with coverage available in all 77 counties. In 2020, Bright Health also joined the Oklahoma exchange and offers plans in Oklahoma, Canadian and Cleveland counties.

  •  If you are currently uninsured: you can visit healthcare.gov to compare plans and enroll in a plan that meets your health care needs.
  •  If you already have health insurance: you will be automatically re-enrolled in your existing plan if it is still available. Even if you are satisfied with your current plan, review your coverage and compare plans to ensure you can select the best option for you.

Keep in mind that cost-sharing subsidies are available only on silver plans and subsidies available on silver plans have changed. Shop around to look for coverage that truly meets your needs. I encourage you to check with your agent to help you sort out your options.

The 2018 legislative session is in full swing up at the Capitol, and we sure started off with a bang. Lawmakers voted on a revenue proposal, known as Step Up Oklahoma, on Feb. 12. Perhaps unsurprisingly, it failed to gain the necessary votes for passage.

The bill had good parts – everyone agrees some extra cash would help Oklahoma. The revenue would have provided teachers with a well-deserved and long-overdue raise. It would have stabilized rocky funding levels for health care workers across the state. It would have allowed lawmakers to focus on big-picture things instead of trying to hurriedly scrape together a bare-bones budget.

But the Step Up package also carried with it proposals I did not appreciate. In fact, in my dozens of conversations with colleagues, no one I spoke to loved everything the plan offered. Step Up was, in the truest sense, a compromise bill. That said, its failure should not dictate where we go from here.

Instead of letting yet another revenue bill’s failure sow anger and exhaustion, I’m choosing to lean into hope that lawmakers can work across party lines to better our state. Casting my ‘yes’ vote on Feb. 12 meant I was saying ‘yes’ to securing a future of which Oklahomans can be proud. Watching the vote fail means I’m recommitting myself to building coalitions of Oklahomans on issues we care about.

Here’s what I know: Oklahomans want better education. Our teachers are some of the brightest, hardworking people I have ever met. They deserve a raise, and House Republicans will continue to fight until educators are properly compensated. I’ll also lobby for local control. Teachers know how to teach their students best. We should encourage independent classroom control, and we should empower parents to be more involved in local schools.

Oklahomans also prioritize economic development. As our tax base grows, we should seek to diversify our economy. Any investor worth his or her salt would advise clients against putting all their eggs in one basket. To strengthen Oklahoma’s economic future, we must spread out our portfolio.

Thirdly, Oklahomans recognize the need for infrastructure improvement. Our state currently ranks third worst in the nation for structurally deficient bridges. The pattern of tapping into funding for roads and bridges needs to stop. We must properly fund our transportation department so we can prevent serious infrastructure problems before more bridges collapse.

These changes aren’t things that can happen with a flick of the wrist. They will take work. Lawmakers have fought for years on these issues, and I will continue to carry the torch with my colleagues. My hope is that you will join me in this effort. Future generations should be able to look back at this session as the year when Oklahomans said ‘yes’ to building a better state.

Legislation Providing More Inclusiveness in OK Veterans Registry Signed into Law

OKLAHOMA CITY – Legislation providing for greater inclusiveness of Oklahoma military personnel and veterans in the Oklahoma Veterans Registry was signed into law by Gov. Kevin Stitt in late April.

The Oklahoma Veterans Registry is a voluntary registry of all Oklahoma residents serving on active duty or in the Oklahoma National Guard, as well as all honorably discharged veterans residing in the state. The purpose of the registry is to provide better access to state and federal benefits.

Rep. Tommy Hardin (R-Madill) and Sen. Frank Simpson (R-Ardmore) were the authors of House Bill 1198, which created the registry in 2017. The law stipulated that the registry must be completed by 2020.

“This tool provides a straightforward way for our veterans to access information about their current state and federal benefits, as well as find out about other benefits they may be eligible for,” Hardin said. “The registry is a simple way for our state to increase the level of care we can provide for our veterans.”

A bill passed this session, Senate Bill 358 by Simpson and Hardin, creates a new requirement that the State Dept. of Health provide a list of all deaths of Oklahoma veterans to the Veterans Registry so that the registry remains current.

Hardin said the registry went live Wednesday. He and Simpson are both veterans and were the first Oklahoma veterans to sign up for the registry. On Thursday, members of the Legislature’s bicameral, bipartisan Veterans Caucus also enrolled in Veterans Registry.

“I am proud to have played a small part in the creation of the Oklahoma Veterans Registry,” Simpson said.  “Our state agencies will now be able to verify veteran status. This will ensure that only our veterans are receiving benefits reserved for them and prevent those who do not qualify from abusing those benefits.”

Kidd honored as Association of County Commissioners Legislator of the Year

 OKLAHOMA CITY – Sen. Chris Kidd, R-Waurika, was named the 2021 Association of County Commissioners of Oklahoma (ACCO) Legislator of the Year during the ACCO summer conference on July 14.

Kidd was chosen for his commitment to helping county government throughout his tenure as a state Senator.  During the 2021 legislative session, he authored and championed five measures to positively reform and update county government operations. The measures included:

 SB 677, which removed the requirement that a court clerk must first offer all or parts of judicial records set for disposal to the Oklahoma Department of Libraries’ Archives and Records Division for preservation as historical research materials. It also modified the time periods certain judicial records must be retained.

SB 736, which allowed for the creation of a health district composed of two or more county boards of health, combining resources and increasing health outcomes.

SB 840, which increased the purchase limit for counties from $15,000 to $25,000, by department.

HB 1063, which authorized counties to employ information technology staff.

HB 1064, which simplified the county salary schedule and increased base salary by $5,000.

 “Growing up the son of a former county commissioner, I know first-hand how dedicated our county employees are to their jobs,” Kidd said. “It’s an honor to work to ensure commonsense laws are on the books to make their jobs easier – not harder – to serve the public. I’m humbled to receive the 2021 Legislator of the Year award, and I look forward to working with ACCO in the future to support county government and employees.”

 ACCO works with 231 county commissioners in all 77 counties to prioritize the health, safety and welfare needs of all county citizens. The organization also serves as a statewide clearinghouse for leadership training, educational programming and other services to meet the needs of its member counties.

Governor Stitt issues Executive Order 2020-13 to protect first responders

OKLAHOMA CITY (April 8, 2020) – Governor Kevin Stitt issued [EO]Executive Order 2020-13, ensuring first responders such as correctional officers, law enforcement and fire personnel who work for state agencies will receive guaranteed paid time off if they contract COVID-19.

“Our first responders put their lives on the line every day to protect their fellow Oklahomans,” said Gov. Kevin Stitt. “There’s no opportunity to work from home in these jobs, so they need our support. I also encourage cities and counties across the state to provide the same benefits to their first responders.”

“I commend Governor Stitt’s quick action in addressing the needs of our first responders,” said Secretary of Public Safety Chip Keating. “Our first responders personify the Oklahoma Standard through their courage and compassion during this unprecedented crisis.”

Executive Order 2020-13 also does the following:

  • Removes barriers that will allow more medical professionals to be on the front lines by encouraging licensing boards to ease requirements on physician assistants, nurse practitioners and retired physicians.
  • Encourages the boards to increase opportunities for students and recent graduates who are not yet fully licensed to practice.
  • Allows closed health care facilities to be re-opened and remove regulatory burdens that would create lag time in getting bed space to treat patients.
  • Allows stretcher vans and stretcher aid vans to assist with emergencies and operate anywhere in the state.

“It is very important to me to break down the geographic silos that limit stretcher vans from operating anywhere in the state,” said Gov. Stitt. “Right now, ambulances and stretcher vans are limited by arbitrary geographic and population-based limits that do nothing but limit the services people in rural Oklahoma can receive. Now is not the time for burdensome regulations.”
